Applicability and updates to this User Privacy Policy
This Policy applies to your use of LookBerry's services (including payment services) and tools (collectively, the "Services"), whether you use them through the www.lookberry.com website or in the LookBerry app. We may make changes to this Policy at any time by posting an updated version on www.lookberry.com and specifying the effective date of the change. You will be notified of material changes by email.
What Personal Information We Collect and Process
We collect your personal information when you use our Services, create a new LookBerry account, provide us information through an online form, add or update the information to your LookBerry account, or otherwise interact with the platform.
Personal Information You Provide When You Use the Services or Create an LookBerry Account
- Data that identifies you: your full name, address, telephone numbers, email, username or your TIN, which you provide when you set up your LookBerry account or later.
- You (as a merchant) use our LookBerry partner payment organizations and provide additional identifying information, such as your TIN and other information (e.g., bank account number).
- Data about special offers, purchases or sales that you provide for a transaction.
- Content that you share with other users through our Services.
- Financial information (such as credit card and account numbers, transaction details and forms of payment).
- Shipping, billing and other information you provide, as well as information required for customs clearance (such as tax identification numbers), and related shipping information (such as shipment numbers and tracking information).
- In some cases: age, gender, country of residence, citizenship, employment status, marital status, interests, and preferences.
- You may provide us with additional information through a web form or by updating/adding information to your LookBerry account, in member chats, dispute resolution, support calls recorded with your consent, or if you contact us for other reasons relating to our Services and the Services.
- Other data that we are required or permitted to collect and process under applicable law and that we need to authenticate or identify you and verify the data we collect.
Personal data that we collect automatically when you use our Services or create an LookBerry account
- Data that is generated as part of one of your transactions (special offers, purchases, sales) or that is linked to your LookBerry account as a result of a transaction in which you participate, such as transaction amounts, time and place of the transaction, a form of payment or payment method.
- Data that is generated as a result of your other activities when you use our Services and that are associated with your LookBerry account, such as when you place items in your shopping cart, in your saved list, search terms or subscribe to other users of the LookBerry platform.
- Data about all other interactions with our Services, your advertising preferences and your communications with us.
- Location data, including your general location (such as your IP address) and the exact location of your mobile device. Note that for most mobile devices, you can control or disable the use of location services for all applications in the settings menu of your mobile device.
- Computer and connectivity information such as statistics about your use of LookBerry services, data traffic information on websites, referral URLs, ad information, your IP address, session times, your browser history, language settings and your blog information.
Personal information we collect regarding the use of cookies
We use cookies and similar technologies to collect data when you use our Services. We collect this data from devices (including mobile devices) through which you use our Services. The collected data includes the following device usage information:
- Data about the pages you visit, session times, frequency and duration of visits, links you click, and other actions you take as part of your use of our Services.
- Information about your activities and interactions with our advertising partners, including how many advertisements are shown to you, how often they are shown, when and where they are shown, and whether you take any action, such as clicking on an ad or making a purchase.
- Device model or type, operating system and browser version and version, device ID/number, cookie-related data (for example, cookie ID).
Personal information from other sources
We also collect personal data about you from other sources and third parties to the extent permitted by applicable law. In particular, this includes the following data:
- Open source data (e.g. demographic data)

Information for seller payment services
verification of data from government or other sources on any previous convictions is performed to the extent permitted by applicable law. We combine the data we receive about you with information from other sources. Information from third parties only comes from verified, legitimate sources.
Data from social media that you share with us
We enable you to use login services (such as Google or Apple) that you already have an account with to create an LookBerry account or link your LookBerry account to such a service. You can specify personal information that we will have access to when you sign in.
Purpose and legal basis of data processing and categories of recipients
We process your personal data on a legal basis that permits such processing.
We process your personal data in order to:
- provide and improve our Services;
- personalize the user interface;
- contact you;
- provide customer service;
- personalize advertising;
- monitor fraudulent or illegal activities.
We also, for the reasons listed above, share your information with third parties, including partner service providers. In addition, we may share your personal information with LookBerry partner companies in order to fulfill our contract with you in accordance with the User Agreement and the Payment Policy.
We process your personal data in order to fulfill our contractual obligations and provide our Services.
This includes the following:
- Processing data relating to you or your company in order to establish and perform a contract with you.
- Displaying your transaction history and feedback. This enables and enhances features such as payment processing, ratings, and LookBerry account management, and helps improve the operability of our Services.
- Processing related delivery information (for tracking purposes), to the extent permitted by applicable law, without your consent.
- Providing our payment services in accordance with our Payment Policy.
- Communicating you (to resolve conflicts and disputes) via notifications on LookBerry, email, phone, SMS, push notifications on your mobile device, or by mail.
- Processing general location data (such as IP address or zip code) to provide you with relevant services (search for content based on geolocation data and other).
- Ensuring compliance with our User Agreement and Payment Policy, this User Privacy Policy and other rules and policies.
- Publishing and promoting your special offers and related content on www.lookberry.com or the LookBerry App.
If we contact you by phone, for efficiency purposes, we may use automated calls or messages in accordance with our User Agreement and Payment Policy under applicable law.
When we share any personal information with third parties, we do so based on an agreement that includes using it only for purposes necessary to fulfill contractual obligations. LookBerry affiliate payment organizations are required to take appropriate security measures regarding this data and are strictly prohibited from sharing the personal data contained in your listings with other third parties.

- Other LookBerry users
- LookBerry corporate members
- LookBerry partner payment organizations
- LookBerry partner shipping companies
- Operators of the www.lookberry.com website and the LookBerry application
We process your personal data to comply with legal obligations.
This includes the following activities:
- Participating in investigations and legal proceedings conducted by government agencies to detect illegal activities.
- Preventing, detecting illegal activities (e.g. fraud, tax evasion and terrorist financing).
- Fulfilling information requests from third parties based on any statutory information rights they may have to our actions (e.g., intellectual property infringement or other illegal activities).
- Ensuring the information security of our Services.
- Storing your personal information in accordance with the specific legal requirements for storing personal information (for more information about storing your data on LookBerry, see “Storage Period. Retention Period and Annihilation of Personal Data”).
If necessary, we will transfer your personal data to data processors and legal organizations:
- Law enforcement authorities, courts, government agencies or public authorities, intergovernmental or supranational bodies (in connection with our payment services provided to merchants, in particular in relation to compliance with applicable laws).
- Third parties on the basis of statutory information requirements for us.
- Third parties who are involved in litigation, in the event that a court decision is provided to us.
- Banks and credit agencies, if required by applicable law (for example, information about late payments, payment defaults, or other irregularities that may be relevant to your credit report).
- LookBerry Partner Payment Organizations
- LookBerry Partner Shipping Companies.
- LookBerry Corporate Members.
We process your personal information to protect your vital interests or the vital interests of another individual.
This includes the following activities:
- Preventing, detecting and investigating unlawful conduct that may result in harm to your essential interests or the essential interests of another individual, except when required by law.
If necessary, we share your personal data for one or more purposes with processors and the following recipients:
- Law enforcement agencies, courts, government agencies or public authorities, intergovernmental or supranational bodies
- Third parties involved in legal proceedings
- LookBerry's partner payment organizations

We process your personal data where necessary to protect a legitimate interest pursued by us or a third party, unless such interests conflict with your interests or fundamental rights and freedoms.
To reconcile our legitimate interests with your rights, we have put in place appropriate controls.
On this basis, we process your data for the following purposes:
- Participation in legal proceedings conducted by courts and law enforcement authorities, public institutions or public authorities, intergovernmental or supranational bodies, in particular for the purpose of detecting, investigating and prosecuting illegal activities, except where provided by law and we can reasonably assume that disclosure is necessary to prevent imminent harm or to report suspicion of an unlawful act. In such cases, we will only disclose data that we believe is necessary, such as your name, city of residence, zip code, telephone number, email address, usernames (previous), IP address, fraud complaints, offertor history and chat history.
- Protecting the legitimate interests of third parties in connection with civil law disputes, except where required by law, if we can legitimately anticipate the need to disclose data to such third parties in order to avoid imminent damages.
- Preventing, detecting, mitigating and investigating fraud, security breaches and other prohibited or illegal activities, including assessing the risks involved (for example, through the use of a phone number stored in your LookBerry account), unless legally required to do so.
- Monitoring and improving the information security of our Services, unless required by law.
- Conducting identity and other financial background checks.
- Automatically filtering and, if necessary, manually checking messages sent using our messaging tools to prevent fraudulent or suspicious activity or violations of our User Agreement or other rules and policies, including prohibiting purchases and sales outside of LookBerry.
- Providing users with features that make transaction processing easier or more convenient (e.g., administering multiple delivery addresses).
- Analyzing and improving the Services by LookBerry corporate members, for example, by reviewing site usage data or information from users about blocked or failed pages to identify and resolve problems and provide you with an improved user experience, including as part of product development.
- Analysis of telephone conversations with our customer service recorded with your consent.
- Mail advertisements (in accordance with your communication settings in your LookBerry account).
- To the extent permitted by applicable law, without your consent, communicating with you via email (such as email or text message) or telephone for the purpose of providing you with discounts and special offers, conducting opinion surveys or market research, or informing you about our Services (in accordance with your communication settings in your LookBerry account). If you do not wish to receive marketing communications from us, you may also unsubscribe by clicking "Unsubscribe" on the email you receive.
- Notifications of promotions and information about our Services after you log in to your account (in accordance with your communication settings in your LookBerry account).
- Customize page content to display items and services you may like based on your actions.
- Evaluating the quality of our email marketing campaigns (e.g., through analysis of opens and clicks).
- Evaluating service status (e.g., based on tracking information if sellers use the Global E-Commerce Fulfillment by LookBerry delivery program).
- Offering affiliate and bonus programs and other joint marketing activities.
- Providing shared content and services (such as registration, transaction processing, and customer service) by LookBerry corporate members, partner payment organizations, or LookBerry partner shipping companies.
- Claiming or defending against lawsuits, including those asserted by one LookBerry user against another user.
If necessary, we share your personal information for one or more of the following purposes:
- LookBerry's partner payment organizations;
- LookBerry's partner transportation companies;
- LookBerry corporate members;
- Other LookBerry users;
- Law enforcement agencies, courts, government agencies or authorities, intergovernmental or supranational bodies;
- Third parties involved in litigation;
- Payment service providers;
- Banks and credit agencies, data verification services, risk assessment providers and collection agencies (e.g., information about late payments, payment defaults or other violations that may be relevant to your credit report or that we use to verify your identity, establish credit limits or collect outstanding debts);
- LookBerry users and others involved in the investigation;
- Other companies (in the context of a company acquisition);
- LookBerry users and other third parties in the event of an investigation of fraud, intellectual property infringement, retail crime, product theft, product piracy or other illegal activity, if we, in our sole discretion, deem an investigation of such incident necessary. In such cases, we will disclose the seller's name, address, city, zip code, country, telephone number, email address and company name to the third party and will bind the third party to an international non-disclosure agreement.

With your consent, we process personal data for the following purposes:
- Marketing communications (e.g., e-mail or SMS), including communications from other LookBerry corporate members or third parties, unless you have not consented under applicable law. We may engage third parties to send marketing messages on our behalf.
- Processing your exact location to provide geolocation-based services.
- Providing a single sign-on service that allows you to register or log in to third-party services using your LookBerry login credentials.
- Processing your personal information to enable you or third parties to access additional services on the LookBerry platform.

We share your personal information for one or more purposes, as appropriate:
- LookBerry Corporate Members;
- External service providers;
- To third parties using our single sign-on service (with your permission on a case-by-case basis);
- Third parties with whom we partner to offer you certain services (as listed by you when collecting appropriate user consent);
- Third-party financial institutions with which we partner to offer you financial products to provide shared content and services (e.g., registration, transactions and customer support). These Third Party Partner Financial Institutions will only use your personal information to send you marketing messages if you have requested their services.
Exchange of data between LookBerry corporate members
As described above under "Personal Data from Other Sources," we also receive access to your data from other LookBerry corporate members. This allows us to provide you with legally compliant information about products and services that we believe may be of interest to you, and to improve the quality of our products, services, content and advertising through analysis, in particular - matching certain data (such as cookie identifiers). It also allows us to prevent, detect and investigate fraud, security breaches and other prohibited or illegal activities, including an assessment of the risks involved.
Transfer of data to LookBerry corporate members
The transfer of personal data between corporate members within LookBerry (e.g. to enable cross-border transactions and for other legally permitted purposes) is based on worldwide personal data protection practices, which are binding internal, corporate data protection regulations or based on other relevant security measures (e.g. standard data protection regulations issued or approved by the European Commission (2010/87 / EU, 2001/497 / EC or 2004/915 / EC). In accordance with our Binding Corporate Rules, LookBerry corporate members undertake to take all possible measures to protect your personal data and to comply with applicable personal data protection legislation.
Retention period and annihilation of personal data
Your personal data will be stored by us and our service providers in accordance with applicable data protection laws to the extent necessary for the processing purposes set out in this User Privacy Policy. We will subsequently delete your data in accordance with our data retention and deletion policy or take steps to appropriately anonymize the data, unless we are required by law to retain information for legally designated retention periods (for example, for legal, tax, accounting or auditing compliance purposes). In Europe, retention periods are usually between 6 and 10 years (in particular for contracts, notices and business letters). To the extent permitted or required by law, we restrict the processing of your data instead of deleting it (e.g. by restricting access to it). This applies in particular where we may still need the data to meet contractual requirements or to approve or defend against legal claims, or where such retention is otherwise required or permitted by law. In these cases, the duration of the processing restriction depends on the relevant statutory limitation period or retention periods. The data will be deleted after the relevant limitation or retention periods have expired. The retention period for personal data may vary depending on the services we provide and our legal obligations under applicable law.
The retention period is generally affected by the following factors:
- The need for our services. This includes activities such as executing the User Agreement, maintaining and improving the quality and performance of our products and services, securing systems, and maintaining appropriate business and financial records. Most retention periods are determined based on this general rule.
- Special Categories of Personal Data. If we retain special categories of personal data (revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, union membership, genetic or biometric data that are processed for the purpose of unambiguous identification, health data, or data concerning an individual's sex life or sexual orientation), a shorter retention period is generally appropriate.
- Consent-based processing of personal data. If we process personal data on the basis of consent (including consent for extended retention), we retain it for as long as necessary for processing.
- Statutory, contractual or other similar obligations. Relevant retention obligations may arise, for example, from laws or official orders. There may also be a need to retain personal data with respect to unresolved or potential legal disputes. Personal data contained in contracts, notices and business letters may be subject to retention obligations depending on national law.
Rights of the user as data subject
Subject to possible limitations under national law, as a data subject, you have the right to access, rectify, delete, restrict processing and data movement with respect to your personal information. In addition, you have the right to withdraw your consent and to object to our processing of your data.

- You can withdraw your consent to the processing of your personal data at any time. Withdrawing consent does not affect the lawfulness of processing on the basis of consent before it is withdrawn.
- You have the right to access your personal data that we use. In particular, to request information on the purposes of the processing, the categories of personal data concerned, the recipients to whom the personal data has been or will be disclosed, the estimated period for which your data will be stored, whether you have the right to request rectification or erasure of your personal data or to restrict or object to the processing of personal data, the right to file a complaint with a supervisory authority, any available information on the source of the personal data (where it is not collected from you), the existence of automated Your right of access may be restricted by national law.

- You have the right to request that we restrict processing to the extent that:
- you challenge the accuracy of the data;
- the processing is unlawful, but you object to the deletion of personal data;
- we no longer need the data, but you need it to approve, enforce or defend legal claims;

- You have the right to file a complaint with the supervisory authority at the controller's place of residence, work or registered office.
If your personal data is processed on the basis of our legitimate interests, you have the right to object in exceptional situations. If your personal data is processed by us for direct marketing purposes, you have the right to object to this at any time.

Other users have access to the information you share on LookBerry. For example, they can see your special offers, purchases, items for sale, search results, ratings and statistics. Other users can also see any information you choose to share on your profile. When you use our services, your public user ID may be publicly displayed. Notifications of suspicious activity and violations sent to other users may relate to your public user ID and specific items. Accordingly, if you use a username that allows others to identify you, those people may see your activities on LookBerry. To protect your privacy, we only allow limited access to other users' contact information, shipping information, and financial information when necessary to facilitate transactions and payments. However, when users participate in a transaction, they have access to each other's names, user IDs, and shipping information.
Your responsibilities with respect to the transactional information you receive through LookBerry
When you complete a transaction with another user (or the transaction has been cancelled, failed, or become invalid), we will provide you with the other user's personal information (nickname, user name, email address, contacts, delivery address, and billing information). Regardless of our policy, you are the controller of such data and are responsible for any processing you do after receiving it, including compliance with the restrictions imposed by this User Privacy Policy and the User Agreement. You may use the personal data to which you have access only for purposes related to LookBerry transactions or for other Services offered through LookBerry (delivery, fraud complaints and member-to-member communications) and for purposes agreed upon directly with the user whose data you have requested. Using the personal data of other users to whom you have access for any other purpose is a violation of our User Agreement.
Personal data relating to third parties
If you provide us with personal data relating to another person, you must obtain their consent, as disclosure of third-party data must be permitted by applicable law. You must inform the person about how we process personal data in accordance with our Privacy Policy.
Filtering messages sent through our tools
All messages sent via our messaging tools are received by us, forwarded to the recipient, automatically filtered according to certain criteria. If necessary, messages are manually checked by our support team. If you violate our User Agreement (including any of our rules and policies), we reserve the right to block the transmission of a message, limit the functionality of your LookBerry account, or block your account. This is to protect against fraudulent or suspicious activity (such as spam, viruses, phishing or other illegal transactions), to enforce our User Agreement and our other rules and policies (such as illegal and other prohibited content), including but not limited to enforcing the prohibition on purchases and sales outside of LookBerry.
Are you obligated to provide us with your personal information?
Some of your personal information that you provide to us is necessary to implement our User Agreement and Payment Policy. For example, you must provide information by which you can be identified, including your real name, date of birth, and tax identification number, in order for us to comply with our legal obligations. Consistent with our Privacy Policy and Payment Policy, we may share this information with LookBerry's partner payment organizations and partner shipping companies for transaction and delivery purposes.
Children's Policy
Our services are not intended for use by children (under the age of 18). We do not knowingly collect personal information from underage users. In accordance with our User Agreement, children are not allowed to be self-employed.
Staying logged in
When you log in to your account, we give you the option to stay in your account for a certain amount of time. If you are using a public computer, we recommend that you work with caution. Any other user of the computer/browser you are logged into will be able to view and access most of the information in your account, and perform certain actions during that log-in period, such as:
- Create special offers;
- Make a sale or purchase;
- View page;
- View or edit order details;
- View profile page;
- Send messages to other members;
- Conduct post-sale activities, such as: requesting a refund or making a claim.
You can usually end your login session by logging out and/or clearing cookies. If you have certain browser privacy settings enabled, simply closing your browser may also end your session. If you are using a public computer, you should log out and clear cookies after using our platform to protect your account and personal information.
